High Court rejects Khaira’s plea against ED probe
In a major setback for senior Congress leader and Bholath MLA Sukhpal Singh Khaira, the Punjab and Haryana High Court on Thursday dismissed his petition seeking to quash the Enforcement Directorate (ED) proceedings against him in the NDPS case.
The court, after reserving its verdict a few days ago, pronounced the order and refused to interfere with the ED’s investigation. This allows the agency to continue its probe and legal action against Khaira.
Khaira’s argument citing Supreme Court’s previous order
In his petition, Khaira had contended that the Supreme Court had earlier quashed the summoning orders in the NDPS case registered in Jalalabad, ruling in his favor. Despite that, the ED raided his residence in 2021 and arrested him in 2023.
Khaira argued that since the original FIR was quashed by the apex court, the ED’s investigation based on that FIR was illegal and unconstitutional. However, the High Court did not accept his plea.
Court’s decision strengthens ED’s position
By dismissing the petition, the High Court has effectively cleared the way for ED to continue its investigation and legal proceedings against Khaira.
This verdict is seen as a major legal blow to Khaira, while giving the agency more authority to proceed with the case.
