What Is the Women’s Reservation Act?

The Women’s Reservation Act, officially known as the Constitution (106th Amendment) Act, 2023, marks a historic step toward increasing women’s representation in Indian politics. The law proposes reserving 33% of seats for women in the Lok Sabha and all state legislative assemblies. It also includes reservation within the SC/ST quota.

The Act officially came into force on April 16, 2024, after the government notified its implementation. This move has been widely celebrated as a milestone in achieving gender equality in governance.

Why Is Immediate Implementation Not Possible?

Despite coming into force, the Act cannot be implemented right away. The primary reason lies in procedural and structural requirements that must be fulfilled before reservation can be applied.

The law clearly states that the reservation will come into effect only after a fresh delimitation exercise is conducted. Delimitation refers to the redrawing of electoral constituency boundaries based on the latest census data.

Role of Census and Delimitation

The next population census, which has been delayed, plays a crucial role in the implementation process. Once the census is completed, a delimitation commission will be formed to reorganize constituencies.

Only after this process will the reserved seats for women be identified and implemented. This means that the reservation is unlikely to be applied before the next general elections.

Political Debate and Concerns

The delay has sparked political debate across parties. Critics argue that linking the reservation to delimitation postpones real benefits for women. Some opposition leaders have demanded immediate implementation without waiting for the census.

On the other hand, the government maintains that proper constituency restructuring is essential for fair and effective reservation.

Impact on Women’s Political Representation

Currently, women make up a relatively small percentage of lawmakers in India. The Act aims to significantly increase this number, empowering women to play a larger role in policymaking.

Experts believe that once implemented, the law could transform the political landscape by bringing more diverse voices into governance.

What Lies Ahead?

The focus now shifts to conducting the pending census and initiating the delimitation process. Until then, the Women’s Reservation Act remains a promising reform awaiting execution.

While the delay may be disappointing for many, the legislation still represents a major step toward inclusive democracy.
