The lawsuit, filed in the U.S. District Court for the Northern District of California, accuses OpenAI of orchestrating a systematic campaign to steal the iPhone maker’s trade secrets. According to the 41-page legal complaint, OpenAI aggressively poached top talent and encouraged former Apple employees to siphon highly confidential hardware files and unreleased product specifications to fast-track its own consumer hardware ambitions.

Former Top Executives Named in Trade Secret Scheme

The lawsuit explicitly names OpenAI, its hardware subsidiary io Products, and two prominent former Apple employees as defendants. The primary individual named is Tang Yew Tan, OpenAI’s current Chief Hardware Officer, who previously spent 24 years at Apple as Vice President of Product Design, overseeing the iPhone and Apple Watch. The second individual is Chang Liu, a former senior system electrical engineer at Apple. Apple alleges that over 400 of its former staffers have migrated to OpenAI, creating a highly organized pipeline for intellectual property leakages.

Controversial ‘Show and Tell’ Recruitment Sessions Exposed

Apple’s legal complaint reveals stunning details about OpenAI’s aggressive recruitment practices. The tech giant alleges that during job interviews, Tang Tan used confidential Apple project codenames to probe candidates about unannounced hardware. More shockingly, the suit claims Tan instructed prospective candidates still working at Apple to bring physical proprietary components—such as advanced batteries and circuit boards—to their interviews for “show and tell” sessions. Apple also states that engineer Chang Liu failed to return a corporate laptop and exploited a system bug to surreptitiously download dozens of confidential hardware presentations and engineering files after joining OpenAI.

Serious Threat to OpenAI’s Upcoming Hardware and IPO Plans

This legal warfare represents a catastrophic collapse in relations between the two tech titans, who previously partnered to integrate ChatGPT into Siri and Apple Intelligence features. Industry analysts note that OpenAI has been working heavily to build dedicated consumer AI devices to reduce market reliance on traditional smartphones. Apple’s filing directly attacks this initiative, stating that “OpenAI’s nascent hardware business now rests on the shakiest of foundations, rotten to its core by its illegal reliance on misappropriated trade secrets.” Legal experts believe the lawsuit could severely derail OpenAI’s highly anticipated Initial Public Offering (IPO) on Wall Street.

OpenAI Responds as Silicon Valley Braces for Impact

In response to the explosive allegations, OpenAI issued a brief statement denying any intentional wrongdoing, asserting that the firm has no interest in other companies’ trade secrets and remains fully focused on developing innovative technology. Apple stated it initially reached out to OpenAI privately to resolve the issue, but filed the suit after receiving no response. The iPhone maker is seeking a jury trial, financial damages, and a strict court injunction to force OpenAI to completely destroy the stolen files and redesign its upcoming hardware products from scratch.
