CCPA Issues Strict Advisory to Hotels and Restaurants

India’s consumer watchdog has issued a strict warning to hotels and restaurants across the country against adding extra charges such as “LPG charges,” “gas surcharge,” or “fuel cost recovery” to customers’ bills. The directive was issued by the Central Consumer Protection Authority (CCPA) after receiving multiple complaints from consumers about hidden fees appearing in restaurant bills.

According to the authority, such charges are often added automatically to the final bill in addition to the menu price and applicable taxes. Officials stated that this practice is unfair to consumers and violates the rules meant to protect customer rights.

The advisory clarifies that restaurants must include operational costs like LPG, fuel, electricity, and other expenses within the menu prices rather than charging them separately on the bill.

Hidden Charges Trigger Consumer Complaints

The action by the CCPA comes after several complaints were registered through the National Consumer Helpline and various media reports highlighting restaurants adding extra fees under different names.

Many consumers noticed charges such as “LPG surcharge,” “gas crisis charge,” or “fuel cost recovery” appearing on their bills without prior notice. These fees increased the total cost of meals even though they were not mentioned on the menu.

Authorities said these hidden charges were being imposed by default, leaving customers with little option but to pay them. The consumer watchdog has termed this practice misleading and a violation of consumer protection guidelines.

Practice Termed ‘Unfair Trade’ Under Consumer Protection Act

The CCPA clarified that adding LPG-related charges to restaurant bills can be considered an “unfair trade practice” under the Consumer Protection Act, 2019.

Under the law, businesses are required to ensure transparency in pricing and avoid imposing hidden charges on customers. Authorities emphasized that the price mentioned in the menu should represent the final price of the food item, apart from applicable government taxes.

The advisory specifically states that no hotel or restaurant should automatically add charges such as LPG fees or gas surcharges to the bill. If establishments continue to follow this practice, they may face legal action.

Officials also pointed out that these charges are sometimes introduced to bypass earlier guidelines regarding service charges, which must remain optional for customers.

Restaurants Must Include Operational Costs in Menu Prices

The consumer authority said that costs related to fuel, cooking gas, electricity, and other operational expenses are a normal part of running a restaurant business.

Therefore, these costs should already be included in the prices listed on the menu. Charging them separately after the meal has been ordered is not allowed.

The advisory also instructs restaurants to ensure that the menu clearly displays the final price of food items, excluding only the applicable taxes such as GST.

Warning of Strict Action Against Violators

The CCPA has warned that strict action may be taken against establishments that violate these guidelines.

Authorities have also urged consumers to remain aware of their rights and carefully check restaurant bills before making payments. If customers notice such charges, they can ask the restaurant to remove them from the bill.

Consumers can also file complaints through the National Consumer Helpline or approach consumer forums if the issue is not resolved.

The move is aimed at improving transparency in restaurant billing and protecting diners from hidden charges.
